- Paid Services: Any premium services (e.g., web hosting, custom plugins, graphic design, GMB and Marketing Solutions etc.) will be billed according to the specific terms agreed upon between Zero Web Pty LTD and the client.
3. Use of Services
- You agree to use our services only for lawful purposes.
- You must not use our services in any way that could damage or impair the functionality of our website, servers, or the networks connected to our systems.
- You are prohibited from using our services for any activity that is illegal, harmful, or violates the rights of others.
4. Intellectual Property
- Websites we build for clients remain our intellectual property until the full service agreement is satisfied. Upon final completion and payment, ownership rights to the website will be transferred to the client.
- You may not reproduce, copy, or redistribute content from the Zero Web website or any of our created works without prior written permission.
5. Client Responsibilities
- Clients must provide accurate, complete, and up-to-date information necessary for the website development process.
- Clients are responsible for the accuracy and legality of the content they provide for their websites (including text, images, videos, etc.).
- Any delays in providing necessary content or information to Zero Web Pty LTD may result in delays to project completion.
6. Payment Terms
- Non-Payment: Failure to pay for paid services will result in the suspension of the services provided, including but not limited to website hosting, domain, and access to premium features.
- Refund Policy: Due to the nature of our services, all payments made for services rendered (such as hosting, SEO, or custom development) are non-refundable. If you wish to cancel any ongoing paid service, written notice must be given 30 days in advance.
7. Website Content & Ownership
- Content: You are responsible for the content of your website. We do not take responsibility for any legal issues arising from the use of copyrighted materials, illegal content, or misrepresentation of facts on your site.
- Ownership Transfer: Upon completion of a project and full payment for any premium services, the ownership of the website design, content, and development work will be transferred to you.
8. Termination of Services
- We reserve the right to terminate or suspend any services at our discretion, especially in cases where clients breach these Terms or engage in activities that we deem harmful, unlawful, or in violation of the agreement.
- Clients may terminate their use of our services at any time by providing us with a written notice. Any outstanding charges must be settled before the termination process is complete.
- In the event of termination, we will provide the client with a backup of their website files and data upon request.
9. Liability & Warranty
- Zero Web Pty LTD does not guarantee that the website or services we provide will be error-free, uninterrupted, or free from security vulnerabilities.
- We are not liable for any loss, damages, or harm resulting from the use of our services, website, or any third-party software, plugins, or tools.
- You understand that any digital services, such as web development or marketing, inherently involve risks, including cyber-attacks, data loss, and service interruptions. While we take reasonable steps to secure all projects, we cannot be held responsible for issues beyond our control
10. Confidentiality
All communications and data shared between the client and Zero Web Pty LTD are considered confidential and will not be disclosed to third parties without the client’s explicit permission unless required by law.
11. Modifications to Terms
Zero Web Pty LTD reserves the right to modify or update these Terms of Service at any time without prior notice. Clients are encouraged to review the Terms periodically to stay informed of any changes.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Melbourne.
